Provisional local alcohol policy notified

Following public consultation on the draft Local Alcohol Policy, the Palmerston North City Council has made the Provisional Local Alcohol Policy in accordance with s.79 of the Sale and Supply of Alcohol Act 2012 (the Act). The Council is now giving public notice of the Provisional Local Alcohol Policy in accordance with s.17 of the Sale and Supply of Alcohol Regulations 2013.

The Provisional Local Alcohol Policy (LAP) establishes the following maximum trading hours for premises licensed to sell alcohol.

OFF-LICENCES All off-licences (e.g. bottle stores, supermarkets and grocery stores) 7am 9pm
CLUB LICENCES All club licensed premises (e.g. RSAs, sports clubs) 8am 12 midnight

The Provisional LAP is available to download from pncc.govt.nz/alcoholpolicy.  The Provisional LAP is also available to view free of charge at the Customer Service Centre, 32 The Square, Palmerston North during business hours.  A copy can be supplied on request.

Making an appeal

Except for the Police and the Medical Officer of Health, only people who made a submission on the draft policy can appeal against an element of the Provisional LAP.

The only ground on which an element of the Provisional LAP can be appealed against is that it is unreasonable in light of the object of the Act. The object of the Act is:

  • That the sale, supply, and consumption of alcohol should be undertaken safely and responsibly; and
  • That the harm caused by excessive or inappropriate consumption of alcohol be minimised.

To make an appeal, please lodge a Notice of Appeal with the Alcohol Regulatory and Licensing Authority (ARLA). Please visit the authority's website for information on this process.

A Notice of Appeal must:

  • be in writing and
  • state your full legal name, address for service, telephone number and your email address; and
  • state the element of the Provisional LAP appealed against, and why the element is unreasonable in light of the object of the Act; and
  • be accompanied by the prescribed fee and include a copy of your submission on the draft LAP.

You must also provide a copy of your notice of appeal to the Council.

Closing date for appeals
