On 1 September 2016, the City Council made a decision on proposed plan change 15A-H to the Palmerston North District Plan. Parts of the plan change are considered operative, but other parts are subject to appeal.

Section 9 Rural Zone
Amendment to Rule 9.5.5 Dwellings, Accessory Buildings and Relocated Dwellings and Accessory Buildings

New performance standard (i) Provision of Water Supply requires firefighting water supply to be provided via either a 45,000L supply or a home sprinkler system (if water-supply for fire-fighting purposes is not available to the lot as a result of a previous subdivision).

Amendments to the 7.4 Method in Relation to Policy 2.8 and 3.1

The implementation of these policies will now be assisted by the provisions of the New Zealand Fire Service Firefighting Water Supplies Code of Practice SNZ PAS 4509:2008.

Amendment to Policy 3.1.1 that requires adequate provision of water supply for firefighting.

North East Industrial Zone Extension Area (Subdivision)
New performance standard for Restricted Discretionary Rule 7.9.2.1. New performance standard (a)(iii)(k) requires a development scheme to demonstrate how firefighting water supply is intended to be provided.

Rural Zone Subdivision
Amendment to Controlled Activity Rules 7.16.1.1 & 7.16.2.1

Any subdivision needs to demonstrate:

• The ability for the proposed lot to provide on-site water supply for firefighting purposes.

New Rule 9.11.2 Noise Insulation: Road Traffic Noise

The new rule requires any new habitable room (including any addition of a new habitable room to an existing building or relocated dwelling) in a building to be used by a noise sensitive activity to be located at least 20 metres from State Highways 3, 54 and 57 and provide acoustic insulation.

New Rule 9.11.3 Noise Insulation: Rail Noise

The new rule requires any new habitable room (including any addition of a new habitable room to an existing building or any relocated dwelling) in a building to be used by a noise sensitive to be located at least 30 metres from the edge of a railway track and provide acoustic insulation.

Section 20 Transportation

New performance standard (e) in Rule 20.3.10 Access: Vehicle Crossings in Proximity to a Rail Level Crossing

The new performance standard requires all new vehicle crossings to be set back a minimum of 30 metres from a rail level crossing.

Amendment to Discretionary Wind Farm Rule 9.8.6(ii)

Amended performance standard (ii) sets a threshold at which wind farm activity will be treated as a non-complying activity where an affected landowner has not given their written approval.

Section 22 Natural Hazards 

Amendment to Permitted Activity Rule 22.7.1.1 (Flood Protection Zone)

New performance standard (v) in Rule 22.7.1.1 allowing non-habitable structures on production land or network utilities within the Flood Protection Zone.

New Restricted Discretionary Rule 22.7.2.2 and Non-Comply Rule 22.7.4.1 were non-compliance with Permitted Activity Rule 22.7.1.1 occurs.

Amendment to Permitted Activity Rule 22.8.1.1 (Flood Prone Areas)

Amended Rule 22.8.1.1 allowing:
(i) Non-habitable structures or network utilities on production land
(ii) The operation and maintenance of existing network utilities or critical infrastructure on production land
(iii) Minor upgrading of network utilities on production land
(iv) Installation of underground network utilities on production land

New Restricted Discretionary Rule 22.8.2.1 where non-compliance with Permitted Activity Rule 22.8.1.1 occurs.

Amendment to Permitted Activity Rule 23.7.1.1 Relationship of the Network Utilities Section to the District Plan as a Whole.

In Rule 23.7.1.1, amend performance standard (a) height to exclude lines’ support structures from the height rule.

In respect of the City West residential growth area, an amendment to Policy 1.1 to recognise:

(i) The importance of appropriately addressing liquefaction risk and mitigation options; and
